Language Notice: These Terms of Service may be provided in multiple languages. The English version is provided for convenience only. In the event of any discrepancies or inconsistencies between the English version and the German version, the German version shall prevail.

These Terms of Service govern the relationship between NextBusiness AG (hereinafter "we" or "us") and the users and organisations that use our services (hereinafter "you" or "customer").

The term "Services" refers to the software-as-a-service (SaaS) solution infinity.swiss as well as the applications and services we provide on the NextBusiness platform.

We reserve the right to make changes to these terms at any time. By continuing to use our services, you agree to the updated terms.

Use of the Services

Software Functionality

For the duration of the agreement, we provide access to infinity.swiss and the applications built on it for paid use.

  • You are responsible for maintaining the confidentiality and security of your infinity.swiss user account. Any liability for data loss or damages resulting from negligence is excluded.
  • You are solely responsible for the lawful and proper use of the software in accordance with applicable laws. This includes, in particular, the use of functions related to accounting.
  • Help texts and instructions within our services do not replace professional advice or training by a fiduciary. We are not liable for damages resulting from incorrect use of the services.
  • You may not use our services for illegal or otherwise unauthorized purposes.
  • You are solely responsible for all content transmitted through your infinity.swiss account, as well as for activities carried out within your created organizations.
  • The use of infinity.swiss through automated means such as bots is not permitted.
  • You are not permitted to copy, modify, or provide the software of our services to third parties without authorization.

These Terms of Service contain limitations of liability.

We reserve the right to remove, modify, or adjust features of the software at any time without prior notice and without providing reasons.

Availability

We strive to ensure the highest possible availability of our services.

However, due to technical reasons, scheduled or unscheduled maintenance, or events of force majeure, we cannot guarantee uninterrupted availability of the software.

Payment and Cancellation

Use of the applications on the infinity.swiss platform is subject to recurring subscription fees, which must be paid at the beginning of each billing period and are automatically charged using your stored payment method.

You may cancel your subscription at any time for the next billing period.

If payments fail, we reserve the right to suspend your subscription and cancel it after repeated failed payment attempts.

We reserve the right to delete data within your organisation after a certain period following subscription cancellation.

Account Termination

We reserve the right to terminate accounts, organizations, and associated data at any time if we detect activities that we consider illegal, undesirable, or otherwise unacceptable.

Data Protection

We take data protection seriously. Our Privacy Policy applies, which you can access here, and for visitors of this website our Cookie Policy.

Liability

To the extent permitted by law, we exclude any liability.

This includes, in particular, liability for damages arising directly or indirectly from the use of infinity.swiss or related applications.

Any liability towards customers for damages resulting from technical failures, force majeure, or negligence is excluded.

You further agree that we are not liable for loss of profits, loss of data, or other immaterial losses resulting from the inability to use our services, unauthorised access to business data, activities of third parties on the services, negligence, or other related matters.

Governing Law and Jurisdiction

These terms are governed by Swiss law.

The place of jurisdiction is Zurich, Switzerland.
